Kate Ewing, Legal Officer for Unison, provides an exclusive briefing to the Institute of Employment Rights on a landmark case to afford intended mothers in surrogacy arrangements the same maternity rights as other mothers.
This briefing focuses on the implications of the CD vs ST case currently being judged by the European Court of Justice. The Court's Advocate General recently recommended that intended mothers are treated equally to other mothers in European law.
